Providing a Reference

Did you know you have a legal duty in providing a reference?

Here are some basic things you should know;

  1. You are not obliged to provide a reference unless the employment contract of the person you are providing a reference for specifically states otherwise.
  2. You have a duty to take reasonable care to ensure that your reference is true, accurate and fair and that it is not misleading.

The duty set out above also means you should avoid;

  1. Failing to respond to specific questions in a request for a reference without explaining why.
  2. Omitting key information that a new employer would expect you to disclose.
